Mike Whitehead Sentenced in Sexual Assault Case

Ultimate Fighter alumnus Mike Whitehead on Thursday was sentenced to one-to-four years in prison for the attempted sexual assault of a woman at his home, according to a report by the Associated Press. The alleged incident took place in April 2010.

Whitehead must also pay $2,400 in restitution and register as a sex offender.

Whitehead, who struck a plea bargain to avoid other charges, was accused of attacking a 32-year-old woman while she slept and of groping a 28-year-old woman, neither of whom the Associated Press identified, following a party at his home.

What exactly did he do? Was there a preliminary hearing held where they laid everything out there? “Attempted sexual assault” could be anything. Anyone know the details of this case?

It sounds to me like he ain’t living straight either way, so maybe some time in jail will straighten him out.

If he plead to attempted sexual assault, then it must have been even more than that. Possibly got out of lewd and lascivious acts if not worse. I think the only reason they plead him down is so they can protect the victims. Oleo them out of the public eye. He’ll be gang raped in prison. Damn sex offenders.

  Good knowledge of the legal system Maddawg. I’m a lawyer in England, and the prosecution generally offer a plea bargain in these instances if they think that the witnesses/victims will suffer the unnecessary stress of a trial and details going public, and the defendant would plead on the basis that more serious charges would be dropped.

If he had any penetration with someone asleep then it would be statutory rape. At least in California. Can’t picture it being different elsewhere in the states.

I might be wrong, but I thought that generally sexual assaults were a harsher crime than lewd ones. I understand that lewd, or lascivious acts covers a wide array of activities. The terminology probably covers different things from one area to the next. The law can be confusing state to state that way.

My guess would be he dealt from the statutory rape charge. (if it’s true he penetrated someone asleep)
